SC dismisses plea seeking to restrain BJP from using lotus as party symbol

The Supreme Court (SC) dismissed the petition seeking injunction against Bharatiya Janata party (BJP) to restrain them from using 'kamal' or lotus as the party symbol.

A bench of Justices Vikram Nath and Prasanna B Varale said that the plea appeared to be filed for publicity. The bench said, ‘You want name and fame for yourself. Look at the plea, what is the kind of relief claimed by you? Dismissed’. The appeal was filed by one Jayant Vipat challenging an order of the Madras High Court which dismissed his plea saying there was no merit in the plea. 

In the petition, Vipat claimed that the BJP as a political party was not entitled to draw benefits which are available to a registered political party in accordance with provisions of Representation of the People Act. He had sought directions to restrain the party from availing benefits for adopting policies in contravention of commitment made to the Election Commission of India at the time of registration as a National Party. Vipat had also sought a decree of perpetual injunction restraining them for using Kamal as a party symbol. Initially, the District Judge, Dewas, had dismissed the suit and the order was challenged in the high court.
