Bills to remove convicted PM, CMs, ministers from power introduced in LS, sent to JPC

Union Home Minister Amit Shah tabled contentious bills in the Lok Sabha that propose that a sitting minister, chief minister or even the prime minister can lose their position within a month if they are arrested or detained for 30 days straight over an offence that carries a jail term of five years or more. The piece of proposed legislation has been sent to a joint committee of Parliament. 

The Bill seeks to add a clause to Article 75 of the Constitution and to other similar laws dealing with Union Territories and Jammu and Kashmir. The bills tabled by Shah are the Government of Union Territories (Amendment) Bill 2025, the Constitution (One Hundred And Thirtieth Amendment) Bill 2025, and the Jammu and Kashmir Reorganisation (Amendment) Bill 2025.

The Bill proposes that a minister in a state or at the Centre would cease to hold office if he/she is arrested and detained in custody for 30 days in a case carrying a punishment which may extend to five years' imprisonment. However, the minister, including the chief minister or the Prime Minister, can tender a reason before the 31st day of arrest to avoid cessation. The legal framework is similar for ministers in states and Union Territories, at the Centre, as well as for chief ministers and the Prime Minister.

Meanwhile, the move to introduce the bills was opposed by Opposition parties. AIMIM president Asaduddin Owaisi compared the Bills to the Gestapo during the Nazi party regime in Germany, adding that the government is trying to convert the country into a police state. Owaisi added, ‘This bill would empower the unelected to play the role of the executionary'. Congress, also sought the immediate withdrawal of these Bills since they violated the Constitutional provisions.
