EC tells Madras HC that actor Vijay’s TVK is not a recognised political party

The Election Commission of India, informed the Madras High Court that Actor Vijay's Tamilaga Vettri Kazhagam (TVK) party was not a recognised political party.

During the hearing of a Public Interest Litigation filed by C Selvakumar, which sought to derecognize Tamilaga Vettri Kazhagam among other reliefs, Niranjan Rajagopal, counsel for EC, made the submission before the First bench comprising Chief Justice M M Shrivastava and Justice G Arul Murugan. The party’s derecognition was sought after a stampede at its September 27 rally in Karur killed 41 persons. Vijay attended the rally.

The bench directed the Registry to place all matters relating to September 27 Karur stampede before the administrative side of the high court, to constitute a bench for dealing with the cases, except those that were pending before the Supreme Court. In so far as the prayer to derecognize TVK, Niranjan Rajagopal said the party was not a recognised one and hence this prayer would not stand.

Though the petition was filed in the Madurai bench of the Madras High Court, it was transferred and listed before the bench headed by the Chief Justice since the first respondent in the case was the Chief Election Commissioner.

In his petition, Selvakumar sought a direction to the ECI to strictly enforce the prohibition on the use of children and women in any political rallies, processions, and election campaigns across the State, in strict compliance with its directive dated February 5, 2024. He wanted a direction that all recognized political parties shall mandatorily submit an undertaking ensuring adherence to the above prohibition, failing which the ECI shall initiate appropriate action including derecognition.

The petitioner has also submitted that despite the legal provisions, the organisers had failed to prevent the participation of minors, women, and vulnerable persons in the meeting, thereby causing death by negligence under Section 304A of the IPC and acts endangering public life under Section 336, 337, and 338 of the IPC. The plea also asks for direction to actor Vijay to pay a minimum of Rs. 1 crore each to the families of the persons who lost life during the stampede.
